The crime of domestic violence involves an assault or assault and battery against someone with whom the perpetrator has a special relationship, i.e. a spouse or former spouse, or an individual with whom he or she has or has had a dating relationship, or an individual with whom he or she has a child, or a resident or former resident of his or her household.
The domestic partner may be married or not married; heterosexual, gay or lesbian; living together, separated or dating. Domestic violence occurs in all ages, races, genders and social classes. The violence takes many forms and can happen all the time or once in a while.

The crime of domestic violence can result in a misdemeanor or felony conviction. Misdemeanor penalties can include up to 93 days in jail and fines of $500.00 to one year in jail and fines of $1,000.00. A domestic violence felony is punishable by up to 2 years in prison and fines of $2,500.00. Sentencing can be enhanced depending on the criminal history of the perpetrator.
